Drones Affecting Commercial Real Estate

The rise in popularity of drones in recent months has prompted questions pertaining to air rights, actionable interference, avigation easements, and nuisance claims. “Droneports” similar in structure to airports may become a reality on the near future, unlike their larger scale counterparts these stations will be located in urban areas. Although research and development of drones is moving right along, the Federal Aviation Administration and its release of regulations regarding drone use is not. It will be no surprise however to see regulations addressing when, where, and how drones will be allowed to take off, and be used as they move into the commercial sector, retail pick-up and delivery for example, which may be seen as early as 1Q17.
